An independent Appeal Board of the Premier League has allowed Leicester City’s appeal against a decision of the Disciplinary Commission which had found it had jurisdiction to consider an alleged breach of the Profitability and Sustainability Rules (Rule E.49) for 2022/23.

The Appeal Board found that Rule E.49 did not apply to the Club at the relevant time, because the Club had ceased to be a member of the Premier League before the end of its 2023 accounting period. The Club therefore did not breach Rule E.49 and the finding of jurisdiction was reversed.

Jane Mulcahy KC and Mark Vinall acted for the Premier League. Nick De Marco KC, David Lowe and Marlena Valles acted for Leicester City FC.
