The Commercial Court has today handed down judgment following the trial of claims brought by McLaren entities against IndyCar racing driver Alex Palou.

Mr Palou admitted liability for breach of contract, following his decision in the Summer of 2023 to remain with his existing team (Chip Ganassi Racing) rather than move to McLaren Indy. However, he denied that McLaren were entitled to any damages and denied alternative claims for unjust enrichment.

The Commercial Court has ruled that Mr Palou should pay damages in excess of $10m for losses incurred in respect of the IndyCar Series (with the final figure to be determined following further work by the parties’ accounting experts). It dismissed the claim for damages in respect of the F1 Series.
