The Supreme Court has given an important judgment in the context of international insolvency, endorsing the immovables rule and rejecting the suggestion that there is a common law power to assist foreign office-holders to claim local immovables. In doing so, the Supreme Court considered the public and private international law foundations of the immovables rule, which were among the matters addressed by Mishcon de Reya LLP in support of its intervention in the appeal.
