The First Tier Tribunal (General Regulatory Chamber) has dismissed an information rights appeal against a decision of the ICO concerning materials held by the FCDO.

The materials sought by the Appellant concerned an investigation by the Cabinet Office into the behaviour of the former Minister, Mr Christopher Pincher MP. The ICO had held that the FCDO was entitled to rely on exemptions under sections 40(2)(personal information) and 36(2)(c)(prejudice to the effective conduct of public affairs) of the Freedom of Information Act 2000. The First Tier Tribunal agreed with the FCDO’s submissions that the relevant materials were exempt from disclosure and dismissed each of the Appellant's grounds of appeal.
