The Grand Chamber of the Court of Justice of the European Union has handed down a decision on 3 April 2025 relating to the interpretation of Article 47 of the Charter of Fundamental Rights.
The Court of Justice accepted the submissions of the United Kingdom that a change to the parole conditions for a detainee – such that a detainee is required to serve at least two thirds of his or her sentence before being eligible for release on licence, even though the previous regime allowed for automatic release at the half way mark – did not constitute a heavier penalty for the purposes of Article 47 of the EU Charter.
